02-16-2007A Warsaw massage parlor was closed this week after a temporary injunction granted in October was made permanent.
Kosciusko County Circuit Court Judge Rex Reed issued a permanent injunction against Dating Dynamics & Massage Inc. and Jeanette Fairchild, siding with the city of Warsaw and closing the business.
On Oct. 17, Judge Reed issued a temporary injunction against Dating Dynamics because the business was operating for more than a year without permits required to satisfy a city ordinance.
During the hearing for the temporary injunction, Fairchild admitted she operated the business without a permit since October 2005.
Inspections conducted by the Warsaw Police Department in June 2006 found Dating Dynamics was in violation of the city’s ordinance regulating massage establishments. After a letter was sent notifying Fairchild of the violation, she was given 10 days to request (in writing) a hearing about the violations.
No request for a hearing was received, and on July 7 Fairchild was notified that her permit was revoked.
Although the permit was revoked, Fairchild continued to conduct business at Dating Dynamics, violating the city’s ordinance.
The permanent injunction approved Tuesday states “...the defendants, each and both of them (Fairchild and Dating Dynamics), their agents, employees and all others under control and in active concert and participation with them and they are hereby permanently restrained and permanently enjoined from operating, conducting, promoting, overseeing, or in any way participating in, directly or indirectly, any massage therapy practices within the corporate limits of the city of Warsaw ... until they, or either of them, comply with the appropriate ordinances of the city of Warsaw regulating massage therapy practices and massage establishments within the city of Warsaw.”
Fairchild also was arrested in October 2006 for allegedly promoting prostitution, a Class C felony. She is set to stand trial for the charge beginning March 20 in Kosciusko Superior Court I.
